Non-recognition by a third country not a bar to divorce.- Lastly, it appears to be advisable to provide that the non-recognition of a divorce by a third country shall not be a bar to the recognition of the divorce in India. Such a provision is contained in the English Act1. The main utility of such a provision lies in this, that it makes the provisions of the proposed Act operative irrespective of the attitudes of other countries-particularly, countries which adopt other tests for recognising divorces. 1. cf. section 7, English Act of 1971. |
