Report No. 99 Oral and written Arguments in the Higher Courts Chapter 1 Introductory 1.1. Genesis.- Some time ago, the Law Commission of India issued a detailed questionnaire seeking the opinion of interested persons and bodies on certain important matters concerning the organisation and functioning of the higher judiciary.1 The questions put forth in that Questionnaire related to a variety of matters, which it is not necessary to enumerate at this stage. It is sufficient to mention that three of the questions related to oral and written arguments in the higher courts. This Report seeks to express the commission's recommendations on the subject, formulated on a consideration of the views received on the questionnaire and other relevant material. 1.
