Report No. 11 169. Section 129.- Section 129 of our Act corresponds to section 79(2) of the English Act, but omits to specify the exceptions which are contained in the Proviso thereto. The exceptions are founded on a sound principle, namely, that there should be no liability where the crossing is not apparent or obliterated or altered in an unauthorised manner and the banker pays in good faith. We have, accordingly, adopted the Proviso. |
