7.66. Section 5(3) to be omitted.-

Section 5(3) deals with certain acts regarding information relating to munitions of war. Briefly, a person who, having in his possession or control any sketch etc., document or information which relates to munitions of war1, communicates it directly or indirectly to any foreign power or in any other manner prejudicial to the security of the state, is punished under the sub-section. We think that most cases of such communication would fall either under section 3(1)(c) or under section 5(1)(a), and, therefore, do not see any need for retaining sub-section (3). We recommend that it should be omitted as a redundant provision.

1. "Munitions of war" is defined in section 2(5).
